Ian Murphy continues to battle Michigan COVID overreach

In a significant legal development, Judge Colin Hunter ruled in favor of constitutional rights, finding specific health mandates used during the COVID-19 pandemic to be unconstitutional. The controversial "gathering statute," MCL 333.2253, granted broad powers to the state health director, affecting numerous businesses including the Iron Pig Smokehouse, owned by Ian Murphy.
Murphy, a vocal opponent of the state's pandemic response, argued that these powers were excessively broad and infringed on individual freedoms and business operations. His restaurant faced repeated shutdowns, curfews, and various operational restrictions under the statute. In a notable 2022 ruling, Hunter highlighted potential constitutional issues with several related statutes, indicating a systemic problem in the delegation of power to executive agencies.

Further complicating matters, Hunter pointed out similar language in local health director statutes, suggesting a pervasive issue across different levels of government. The laws in question date back to 1978 and have been criticized for allowing executive agencies too much leeway in creating and enforcing public health policies without adequate legislative oversight.
The implications of Hunter's rulings extend beyond the Iron Pig, potentially affecting numerous other businesses across Michigan. These establishments, some of which have ceased operations due to stringent health mandates, have expressed interest in pursuing similar legal challenges.
The state now faces significant pressure to reassess its public health laws, particularly in light of this judicial scrutiny. Murphy remains steadfast in his commitment to challenge what he perceives as governmental overreach, reflecting a broader sentiment among business owners impacted by pandemic-era policies.
